PWInsider has reported another update in the ongoing lawsuits against WWE due to lack of protection for the health and well-being of their performers in regards to concussions, CTE and head trauma. Judge Vanessa L. Bryan reportedly ruled yesterday that former WWE Superstar Vito LoGrasso and former developmental talent Evan Singleton could move forward with some discovery.
The discovery motion allows LoGrasso and Singleton to investigate the following:
* If WWE should have had the knowledge and had a duty to disclose to the plaintiffs the long-term risks and potential degenerative neurological conditions from concussions or mild traumatic brain injuries for pro wrestlers. This would apply to wrestlers who worked for WWE in the year 2005 or later.
* Whether and when WWE may have breached that duty.
* Whether the breach, if any, continued after Singleton and LoGrasso had left WWE.
In addition, this ruling will allow the former talents to have access to WWE records for the express purpose of trying to prove their allegations. However, it will only cover the cases for specifically LoGrasso and Singleton. WWE currently has until August 1 to file a motion that the discovery should not move forward.
WWE has other similar lawsuits brought against them by former WWE Superstars, including Billy Jack Haynes, Ryan Sakoda, Matt Wiese (aka Luther Reigns), Russ McCullough, the estate of the late Nelson Frazier Jr. (aka Mable, Viscera and Bigg Daddy V), and Michelle James. WWE recently had all these lawsuits moved to the state of Connecticut in 2015.
Opinionated View- I am going to keep saying this because its what I believe. All these cases are going to be very hard to prove. With people like Vito, Haynes, or Frazier you have guys that wrestle in numerous companies besides WWE. Also I'm not sure if you can prove where and when brain damage took place. I don't know if a doctor can actually get on a witness stand and say "The majority of the damage took place during his time of employment."
